Since the commencement of the Wine Industry Award on 1 January 2010 the definition of ‘vintage’ within the Award was for a set period of 1 November to 30 April each year.  A change was sought on behalf of wineries and winegrape growers by the SA Wine Industry Association (SAWIA) to ensure that employers in cooler-temperate districts would be able to utilise expanded ordinary hours in the vineyard during vintage.

A decision and determination in this matter was issued by the Fair Work Commission in mid-December 2013 and results in Clause 27.2(d) of the Award being amended.  This change will come into effect on and from 20 January 2014.

The Wine Industry Award 2010 will be varied to read as follows (selected excerpts):

(i)  For the period of vintage, the ordinary hours of work for an employee rostered to perform work in the vineyard are to be worked continuously, except for meal breaks, between the hours of 5.00 am and 6.00 pm Monday to Saturday.

(ii)  For the purposes of this clause, “vintage” means a period not exceeding six months between the months of November and June inclusive that starts on the date when the harvest of wine grapes begins at a particular site (vineyard) and ends on the date the last wine grapes are harvested at that site.
